  1. Definitions:

    • 'wthax.org' refers to the code, design, look and feel of this website.
    • 'File' refers to any document uploaded to, hosted on, or related to wthax.org.
    • 'User' refers to any person or persons who accesses files on wthax.org, or uploads or has uploaded any files to wthax.org.

  2. Terms of Use:

    THE FOLLOWING TYPES OF FILES MAY NOT BE UPLOADED UNDER ANY CIRCUMSTANCES:

    • Files that violate the laws of the United States of America, or the state or country in which the User or Users reside.
    • Files which infringe upon copyrights, trademarks, or intellectual property rights of others.
    • Files that are represent people who are under 18 posing or taking part in any sexually explicit and/or implicit situations
    • Files whose intended purpose is for harassing another person or group.
    • Files whose intended purpose is for the promotion of products or services through direct advertisements.

    Images uploaded to wthax.org are meant for a final destination on the website http://www.boards.ie and certain related sites. Hotlinking from any other website is an offense equal to a breach of the above terms.

    Users may not access wthax.org or any wthax.org server in any manner with the intended or actual effect of disrupting, overloading, damaging, gaining unauthorized access to, or in any way adversely affecting the wthax.org service.

    Please report violations of the above terms to the support link on the front page.

    Violation of any of the above terms may result in punishments including, but not limited to:

    • Removal of ability to access images hosted on wthax.org.
    • Removal of images uploaded by the user.
    • Prosecution.

  3. Privacy Policy

    wthax.org may collect and store information about Users, including their IP address and and other demographic information reported by the User's browser. By using the wthax.org website or services, you agree that wthax.org may use and distribute demographic information. wthax.org will never disclose any other information except in the following cases:

    • wthax.org believes that the User has, is, or will violate the Terms of Use.
    • The User has committed unlawful acts
    • The information was subpoenaed

  4. General Legal Information

    Ignorance of these Terms of Use is not a justification for violation of the aforementioned Terms of Use. The Terms of Use are subject to modification without notice. The individual users have full legal responsibility for the contents of the files that are uploaded to wthax.org.

    No part of wthax.org, including but not limited to images owned by wthax.org, website design, and code, may be reproduced or recreated without explicit written permission by the providers.

  5. Limitation of Liability

    User agrees that the use of any services provided by wthax.org is entirely at the User's own risk, and provided on an "as-is" basis without warranties of any kind, expressed or implied, including but not limited to warranties of merchantability, non-infringement, or fitness for a particular purpose.

    wthax.org has no guarantee of availability of service and reserves rights including but not limited to changing or terminating service. Under no circumstances shall wthax.org be liable for any damages or injury of any sort arising from the services or any content within.

    In addition, User agrees to indeminify and hold wthax.org and all operators and copyright holders harmless from any loss, liability, damages, expenses, or claims, including but not limited to attorney's fees and court fees, arising from or related to the content of, or deletion of User's Files or use of any other service provided by wthax.org. This expressly includes but is not limited to:

    • User's responsibility and liability for infringement of intellectual property rights or copyrights.
    • User's responsibility and liability for unlawful and defamatory material contained within User's Files.

  6. Downtime

    wthax.org retains the right to perform maintenance services as wthax.org staff determine reasonable. User acknowledges that such maintenance may require downtime, and may result in the accidental or intentional deletion of User's Files.

  7. Restrictions

    If any provision in these Terms of Use is invalid or unenforceable under applicable law, the remaining provisions continue with full force and effect, and the invalid or unenforceable provision shall be superseded by a valid, enforceable provision that most closely matches the intent of the invalid or unenforceable section. Failure to exercise or enforce any right or provision under these Terms of Use do not constitute a waiver of said provision or right.

  8. Indemnification

    User agrees that they shall defend, indemnify, save and hold wthax.org harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorneys' fees, ("Liabilities") asserted against wthax.org, its agents, its customers, servants officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by User,its agents, employees or assigns. User agrees to defend, indemnify and hold harmless wthax.org against Liabilities arising out of

    • any injury to person or property caused by any products sold or otherwise distributed in connection with wthax.org;
    • any material supplied by User infringing or allegedly infringing on the proprietary rights of a third party;
    • copyright infringement;
